Data protection 

As of May 25, 2018, the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (RODO) apply. 

W PM Development Group We attach particular importance to protecting the data of our Clients, Contractors and Employees. For the sake of information security, we process personal data taking into account the provisions of RODO and other regulations on personal data protection. 

1. about the personal data controller 

The administrator of the personal data is PM Development Patryk Cruz Materna with its registered office in Nowa Sól (67-100) at Wesoła 19 a/4 Street. 

2 Legal basis for data processing by PM DEVELOPMENT 

The processing of personal data by PM DEVELOPMENT is based on at least one legal basis under the RODO, i.e. when: 

(a) the data subject has consented to the processing of his or her personal data for one or more specified purposes; (b) the processing is necessary for the performance of a contract to which the data subject is a party, or to take action at the request of the data subject prior to entering into a contract; 

(c) processing is necessary for the fulfillment of a legal obligation incumbent on the controller; 

(d) processing is necessary to protect the vital interests of the data subject or of another natural person; (e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller; (f) processing is necessary for the purposes of legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

4 Rights of data subjects 

The RODO provides data subjects with a high level of protection by, among other things, granting appropriate rights, such as: 

(a) the right of access to data - the data subject has the right to receive information about, among other things, what data PM Development as controller processes, for what purposes it is processed, and to obtain a copy of the data;

(b) Right to erasure (right to be forgotten) - the data subject may indicate the circumstances justifying the requested erasure, e.g. the data are no longer necessary for the purposes for which they were collected, and there is no legal basis for further processing, or the data are being processed unlawfully; The right to erasure may be exercised only in situations where PM Development has no legal basis for processing the data. Please note that if you have an "active" (pending, active) contract with PM Development, data processing is necessary for its execution and personal data cannot be deleted. After the termination or expiration of the period for which the contract was concluded, PM Development has a legal basis for further processing of personal data in its legitimate interest and resulting from legal obligations incumbent on PM Development .The period of further data processing results from the applicable regulations and until its expiration the Client's request for data deletion will be impossible to implement. 

(c) the right to data portability - the data subject has the right to receive in a structured, commonly used machine-readable format the personal data concerning him or her that he or she has provided to PM Development A request for data portability may be submitted by the data subject. The information will be provided in the form of a file transmitted to the Client through an established secure communication channel. 

(d) the right to restrict data processing - the data subject indicates that the prerequisites set forth in Article 18 of the RODO for restricting the processing of his/her data have occurred, e.g. when PM Development does not need certain data, there are no prerequisites for further data processing, and the Client requests to stop data operations or not to delete the data; Each request for restriction of data processing will require individual consideration in terms of the existing grounds for data processing, the purpose and scope of data processing. 

(e) Right to rectification of data - at any time when the need arises, the data subject shall inform PM Development of changes to his/her personal data; Customers may request PM Development to rectify inaccurate or complete incomplete data. 

(f) The right to object - at any time you can object to the processing of your data by automated means, including profiling, as well as object to the processing of your data for marketing purposes; You can object to the processing of your data by, for example, e-mail, by letter to PM Development, or by calling PM Development's hotline .Objecting to profiling means that the Client's personal data will not be processed by automated means, except in exceptional cases specified in applicable law. Consequently, PM Development will not be able to apply a simplified service path to the Customer and assess your needs in order to make a personalized proposal of products and services to PM Development and PM Development's affiliates. 

5. how to apply to PM Development to exercise rights ? 

In order to exercise your rights, it is enough to turn to PM Development, e.g. via e-mail biuro@pmd2.pl or by letter to the address of PM Development headquarters Wesoła 19 a/467-100 Nowa Sól street. Pm Development will respond within one month from the date of application. For exceptional reasons, this deadline may be extended by another 2 months, of which the applicant will be informed separately. 

6 To whom PM Development may share data 

PM Development may share data in the group specified by the cooperation, with entities and bodies to which it is obliged or authorized to provide them under generally applicable laws, including entities and bodies authorized to receive them on the basis of consent or entities authorized to request access to data under generally applicable laws. 

7 Period of data processing 

Personal data is processed for the purposes arising from generally applicable laws also after the termination of the contractual relationship between the Client and PM Development . PM Development has obligations and entitlements related to the processing of data for archival purposes, as well as to establish and assert claims by PM Development in connection with its activities, including taking actions to find buyers and sell apartments, acquiring real estate agents , acquiring contractors.

If PM Development fails to act on the data subject's request, the Client has the right to file a complaint with the supervisory authority and may pursue remedies in court. 5. how to address PM Development with a request for the exercise of rights
